As a result of the Lebanese Civil War, many parts of Lebanon have come to resemble large construction sites. ElKhoury Law Firm has been instrumental in numerous large real estate transactions between domestic and foreign parties. We can provide legal advice regarding every stage of a construction project from the original flaunting to the closing stages. This includes the original studies of the site and the building, the bidding process, the representation of the parties, the contracts with the engineers and the owners, assembling the construction documentation for the contractors and the project management. We have extensive experience in all kinds of FIDIC practices in Lebanon and the Middle East. We also have experience in BOT contracts (Build, Operate and Transfer) whose use is becoming more and more common. We have been engaged in BOT contracts and joint ventures involving foreign and domestic parties.

We manage the disputes endemic to construction such as cost overruns, adherence to schedules, bonds, bank guarantees, non conformity, non delivery, and sub contracting issues in a way that preserves the integrity of the project. We have a familiarity with the various players involved in the construction industry and the necessary know-how to coordinate between borrowers, developers, lenders, contractors, project managers, real estate funds and institutional funds. We are also familiar with litigating disputes arising from these transactions, including liability suits for injury on building sites and for faulty construction.

In terms of real estate, we have experience in sale and purchase agreements, mortgages, allotments, division of property rights, and liquidation of joint properties. The Middle East has very particular laws concerning the purchase of real estate by foreigners. We have the cultural and business familiarity to communicate to foreigners all aspects of the financial and regulatory implications of purchasing property in the region.

We have drafted agreements for the lease, purchase and sale of buildings under construction to safeguard the rights and interests of property developer and purchasers. We have represented landlords and tenants in commercial and residential tenancy disputes, and in securing the necessary mortgages and liens.
